1. About This Privacy Policy#

  • MobileGadgetsWorld operates as a technology-enabled marketplace intermediary.
  • We are not manufacturers of products unless explicitly stated on the product page.
  • We act as a facilitator between users, sellers, payment gateways, and logistics partners.

  • Email address
  • Billing and shipping address
  • Order, invoice, and transaction details
  • Limited payment metadata (processed via secure gateways only)
  • Communications with customer support
  • Reviews, feedback, survey responses

Once personal data is provided, you are not anonymous to us.

3.2 Verification & Evidence Data (Critical)

To prevent fraud and resolve disputes, we may collect:

  • Mandatory unboxing videos/images
  • Delivery confirmation data
  • Courier proofs (OTP, signature, tracking logs)

This data is used strictly for fraud prevention, dispute resolution, chargeback defense, and legal compliance.

  • Device identifiers & device fingerprinting data
  • Browser type and operating system
  • Log files, timestamps, clickstream data
  • Approximate location (via IP)

Used for security monitoring, fraud detection, risk scoring, and platform optimization.


4. Purpose of Data Use#

We use your data to:

  • Process and fulfill orders
  • Deliver products and services
  • Process payments, refunds, or replacements (where eligible)
  • Communicate via SMS, Email, WhatsApp, or Calls
  • Detect and prevent:

    • COD abuse

  • Assist sellers, logistics partners, and payment providers

5. Fraud Prevention, COD Control & Order Security#

To protect genuine users, sellers, and the Platform:

  • Orders may be verified, delayed, restricted, or cancelled if flagged by security systems.
  • Cash on Delivery (COD) may be disabled for:
    • High-risk users or addresses
    • Repeated RTO (Return-to-Origin) history
  • Price Protection Clause: Refunds or returns are not permitted due to price drops after order placement.
  • Addresses, devices, or accounts involved in repeated abuse may be blacklisted.

All fraud-prevention decisions are final and binding.


6. Mandatory Unboxing Video Policy (Theft & Damage Protection)#

For mobiles, laptops, electronics, wearables, and accessories, the following is MANDATORY for any claim related to damage, defect, missing, or wrong items:

Unboxing Video Rules

  • Video must clearly show all six sides of the sealed courier package.
  • Shipping label must be clearly visible.
  • Video must be continuous, unedited, and uninterrupted.
  • Recording must start before opening and continue until product inspection.

Result

❌ No valid unboxing video = No refund or replacement

This policy exists to prevent fake claims and return fraud.

Critical Policy

Ensure you record a continuous, unedited video showing the shipping label and all sides of the package before opening. Without this, claims will be rejected.

7. Marketplace Role & Seller Responsibility#

Sellers are solely responsible for:

  • Product authenticity and legality
  • Quality, specifications, and descriptions
  • GST and statutory compliance
  • Warranty commitments (if any)

MobileGadgetsWorld:

  • Does not assume liability for manufacturing defects or seller misconduct.
  • May facilitate communication between buyer and seller.
  • May suspend, terminate, or report sellers involved in fraud or violations.

8. Safe Harbour Protection (IT Act, 2000)#

MobileGadgetsWorld qualifies as an intermediary under Section 79 of the Information Technology Act, 2000.

Accordingly:

  • We do not control seller-generated content beyond platform moderation.
  • Liability for listings rests with sellers or manufacturers.
  • We claim safe-harbour protection to the maximum extent permitted by law.

9. Data Sharing & Third Parties#

We share data only when necessary, with:

  • Logistics partners (delivery & RTO management)
  • Payment gateways (secure processing; gateway fees are non-refundable)
  • Fraud-detection & risk-analysis partners
  • Legal or government authorities when required by law

🚫 We never sell personal data to third-party marketing agencies.


10. Chargebacks, Bank Disputes & Evidence Use#

In case of payment disputes or chargebacks:

  • Transaction logs, IP data, delivery proofs, and unboxing policies may be shared with banks.
  • Refunds may be paused during investigation.
  • False chargebacks may result in permanent account suspension.

MobileGadgetsWorld is not liable for bank or gateway delays.


11. Data Retention & Security#

Data is retained only as long as necessary for:

  • Order fulfillment
  • Legal, tax, and audit compliance
  • Fraud prevention and dispute resolution

We use SSL encryption, access controls, monitoring, and audits.

Users are responsible for protecting their login credentials.


12. User Rights (DPDP Act, 2023)#

You have the right to:

  • Withdraw Consent (may result in service/account termination)
  • Right to Nominate another individual to exercise rights in case of death or incapacity

14. Intellectual Property & Platform Abuse#

All Platform assets including:

15. Limitation of Liability#

Maximum liability of MobileGadgetsWorld is limited to the actual amount paid for the product.

We are not liable for:

  • Seller misconduct
  • User negligence
  • Courier delays
  • Third-party outages
  • Indirect or consequential losses

16. Indemnity (Seller & User)#

Sellers and users agree to indemnify and hold harmless MobileGadgetsWorld from:

  • Fraud
  • False claims
  • Legal notices
  • Policy violations
  • Chargeback abuse

17. Force Majeure#

We are not liable for delays or failures due to:

  • Natural disasters
  • Government restrictions
  • Strikes or lockdowns
  • Internet or power failures
  • Events beyond reasonable control

18. Governing Law & Jurisdiction#

All disputes are subject to the exclusive jurisdiction of the courts in Delhi.
